Article 1 – Definitions

In these terms and conditions:

 

Offer: an offer of a certain good at a certain price, if the Customer accepts this, an agreement is concluded;
Purchase price: the price of each Product is displayed on the https://www.littlewoofs.be/ in Euro, excluding shipping costs;
General Terms and Conditions: a part of the agreement that regulate  specific matters;
Reflection period: the period within which the consumer can make use of his right of withdrawal, which corresponds to 14 days;
Consumer: someone who buys something not for his or her profession or business, but for personal use;
Cookies: text files that are placed on your computer
Day: calendar day;
Direct costs: costs that can be charged directly to the product units
Direct marketing: promoting products by approaching potential Customers directly and personally
Warranty: an undertaking entered into by Little Woofs to refund, repair or replace the price paid if there is a lack of conformity;
Defect: a non-compliance with the description;
Right of withdrawal: the option for the consumer to waive the distance contract within the cooling-off period;

Mitigation: Convert an invalid clause into a valid clause;
Model form: the model form for withdrawal that Little Woofs makes available that a consumer can fill in if he wants to make use of his right of withdrawal;

Distance Agreement: An agreement whereby exclusive use is made of one or more techniques for distance communication up to and including the conclusion;

Article 3: General provisions

3.1 The e-commerce Little Woofs of Evelien Vandemarck, a sole proprietorship with registered office at  Glazenstraat 21, 2220 Heist-Op-Den-Berg with  VAT number: BE0759 888 892, offers its Customers the option of offering the products from its webshop online. to buy. The general terms and conditions that you can find below  apply to every order placed by a visitor to https://www.littlewoofs.be/ . You can print these general terms and conditions or we can also send you a written copy at your request.

 

3.2 When you place an order, you must expressly agree to the terms and conditions. You hereby indicate that you agree with the delivery and payment conditions and you also declare that you master the language of the general terms and conditions. Additional conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by Evelien Vandemarck.

 

Article 4: progress order

The ordering procedure via the website https://www.littlewoofs.be/ is as follows:

  1. Indicate the desired product
  2. Choose the right product variant; size, color, design.
  3. Add the chosen product variant to the online shopping cart
  4. Once all desired products are in the shopping cart, go to the shopping cart to pay.
  5. Click checkout.
  6. Enter the requested billing information.
  7. Choose the payment method and pay.
  8. When you have completed the order you will receive an email with an overview of the order
    placed order.

Your order will be processed as soon as payment has been received by us.
Once the order has been processed, you will receive an email from us that the order has been processed
has been shipped, you will receive a track & trace code from us with which you can track it until delivery.

 

Article 5: Offer

Every offer is without obligation. Little Woofs is entitled to change and adapt the offer. If the Customer places an order, he accepts the offer. However, Little Woofs reserves  the right not to accept your order if:

  • The information entered by the customer is not correct or complete and if Little Woofs doubts the correctness of this information;
  • The customer has not fulfilled a previous payment obligation;
  • The customer has not accepted delivery of a previous order and/or has not collected a previous order;
  • The delivery address indicated by the customer is in a country where Little Woofs does not deliver.


5.2  If the Customer has specific questions about, for example, sizes, colour, availability, delivery time or delivery method, we request that the Customer contact our customer service in advance via https://www.littlewoofs.be/ .

 

5.3 The offer is always valid as long as stocks last and can be adjusted or changed at any time

withdrawn by Little Woofs. Evelien Vandemarck cannot be held liable for the unavailability of a product.

 

5.4 If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.

 

Article 6: Price

6.1 The price of each product is displayed on the https://www.littlewoofs.be/ in Euro. This price does not include shipping costs and applies in all countries. Little Woofs is exempt from VAT and therefore does not charge this to the customers.

 

6.2 Any discount or purchase voucher granted to the Customer will be deducted from the Purchase Price

 

6.3 Prices will not be increased within the term of the offer, unless legal measures make this necessary or the manufacturer implements interim price increases.

 

6.4 All prices on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.

 

Article 7: payment

7.1 The Customer must pay the amount due to  account number BE40 7390 2132 6863  and  has the choice between the following payment methods:

- bank contact

- KBC / CBC app

- ING app

- Belfius directly

- IDEAL

 

Article 8: delivery and export

8.1 Little Woofs works together with B-Post for the shipment. The delivery can be tracked via a track & trace code. The shipping costs are (subject to any changes by B-Post):

  • For Belgium: 6,20 euros
  • For the Netherlands: 8.95 euros
  • For Germany: 12.50 euros
  •  ...

8.2 Orders delivered outside the European Union may be subject to additional surcharges and/or taxes. These surcharges and/or taxes are expressly not included in the total price referred to in Article 6. Any additional costs based on these surcharges and/or taxes are for your account and risk.

 

8.3 Unless otherwise agreed or expressly stated otherwise, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order and payment for the goods.

 

8.2 All delivery times are indicative. The consumer cannot derive any rights from any stated terms. Exceeding a term does not entitle the consumer to compensation.

 

8.3 Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately by the Customer to Little Woofs via info@littlewoofs.be.

 

8.4 Little Woofs indemnifies itself against all damage or loss resulting from third parties upon delivery, which will therefore not be reimbursed by us.

 

Article 9: Retention of title and transfer of risk

9.1 The delivered articles remain the exclusive property of Evelien Vandemarck until full payment by the Customer, regardless of the delivery date of the aforementioned product.

 

9.2 The Customer undertakes, if necessary, to point out the retention of title of Little Woofs to third parties, e.g. to anyone who would seize items that have not yet been fully paid for.

 

9.3  The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. The postmark serves as proof of the delivery date. However, the risk already passes to the customer upon delivery to the carrier, if the carrier has been instructed by the customer to transport the goods and this choice was not determined by Little Woofs.

 

Article 10: Return Policy

10.1 The provisions of this article only apply to Customers acting in their capacity as consumers

purchase articles at https://www.littlewoofs.be/, hereby a distance agreement takes place.

 

10.2 The Customer has according to Article VI. 47 WER has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the good.

 

10.3 To exercise the right of withdrawal, the Customer must

either send an unambiguous written statement by post (Glasenstraat 21, 2220 Heist-Op-Den-Berg) or by e-mail (info@littlewoofs.be
It is sufficient that the customer has sent his notice of withdrawal within 14 days.

 

10.4 In the event of cancellation, the customer must return the products to  Glazenstraat 21, 2220 Heist-Op-Den-Berg or hand them over to Evelien Vandemarck within 14 calendar days after he has communicated his withdrawal decision to Little Woofs. It is sufficient if the goods are returned within 14 calendar days. The direct costs arising from returning the goods shall be borne by the Customer.

 

10.5 The Customer is requested to return the items in their original condition and packaging,

with all included accessories, manuals and the original price label. If the returned product has diminished in value in any way, Little Woofs reserves the right to hold the Customer liable and claim compensation for any diminished value of the goods resulting from the use of the goods by the Customer beyond what is necessary to establish the nature, characteristics and functioning of the goods. All returned items are carefully examined. The starting point here is that the consumer may only inspect and try on the article, but may not use it. This is similar to what he would be allowed to do in a shop.

 

10.6 Is your package damaged on arrival?

Let us know within 24 hours and send us a photo. Then we will look into this further together.

 

Article 11: Warranty

11.1 The Customer can hold the seller accountable for any lack of conformity that manifests itself within 2 years after delivery. To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

 

11.2 The Customer must inform Little Woofs within 2 months by e-mail (info@littlewoofs.be) after discovering the lack of conformity. If the Customer fails to report this to Little Woofs within 2 months, he loses the right to repair or replacement.

 

11.3 If the consumer has reported the defect within 2 months, he has one year from the discovery of the defect to institute legal proceedings. However, this period cannot expire before the period referred to in 11.1.

 

11.4 The (commercial and/or legal) guarantee never applies to defects that arise as a result of accidents, neglect, falls or due to the use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual; adjustments or changes to the article, heavy-handed use, poor maintenance; if the consumer has repaired and/or modified the delivered products himself or had them repaired and/or modified by third parties; any other abnormal or incorrect use.

 

11.5 The website makes every effort to describe and display the products as accurately as possible. However, it is impossible to reproduce the real color of the products completely natural on the screen. In addition, the color reproduction depends on the computer equipment used by the customer, so that Little Woofs cannot be held liable for the reliability of the colours. The documents associated with the products (images, texts and other descriptive elements) are for illustrative purposes only and do not constitute any contractual commitment. 11.6 Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to evidence to the contrary by the Customer.

 

Article 12: Privacy

12.1 When the Customer consults https://www.littlewoofs.be/   , makes purchases via the webshop, contacts us, etc., the Customer authorizes Evelien Vandemarck to process his personal data in accordance with this privacy statement.

 

12.2 When you visit https://www.littlewoofs.be/, certain information is processed that is automatically collected or voluntarily provided by you, including the following data (non-exhaustive list):

  • Personal information, such as your first and last name.
  • Contact information, such as your email address, telephone number and address.

12.4 Little Woofs does not sell your information to third parties and will only provide it if this is necessary for the execution of our agreement with you or to comply with a legal obligation. We conclude a processing agreement with companies that process your data on our behalf to ensure the same level of security and confidentiality of your data.

 

12.5 Little Woofs processes this data on the basis of, among others, the following legal grounds (non-exhaustive list):

We need to process your personal data to perform our contract. For example, we need payment and contact information to process the order.

12.8 The Customer has the right to object free of charge to any processing of his

personal data for direct marketing purposes. The Customer has the right to submit a complaint to the Commission for the Protection of Privacy (Drukpersstraat 35, 1000 Brussels - commission@privacycommission.be).

Article 13: Use of Cookies

Article 14: Customer Service

Little Woofs customer service can be reached by e-mail at info@littlewoofs.be or by post at the following address:  Glazenstraat 21, 2220 Heist-Op-Den-Berg.

Any complaints can be directed to this. Evelien Vandemarck will deal with every complaint within 14 working days. If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within the period of 14 days with a notice of receipt and an indication when the consumer can expect a more detailed answer.

 

Article 15: Dispute settlement

15.1 The Customer accepts that electronic communications and back-ups can serve as evidence.

 

15.2 In the event of a dispute, an amicable solution will first be sought, only if this is not possible can a dispute resolution procedure be taken to court (see 15.3 et seq.).

 

15.3 Belgian consumer law applies to disputes between consumer and seller. If the consumer lives abroad, the Vienna Sales Convention applies.

 

15.4 The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).

 

 

Article 16 – Changes to the general terms and conditions

16.1 If any provision of these terms and conditions is declared invalid, illegal or void, this will not in any way affect the validity, legality and applicability of the other provisions. Preference will also always be given to the moderation of the void provision to legal clauses.

 

16.2 Little Woofs may change these terms and conditions at any time. The most recent version of the general terms and conditions will always be published on https://www.littlewoofs.be. When placing an order, the Customer agrees to the general terms and conditions that are published at that time.
